DEFINE MY DAY™ TERMS OF SERVICE

1. ACCEPTANCE

By using the Service, you agree to these Terms. If you don't agree, don't use the Service.

2. ELIGIBILITY

You must be at least 13 years old (or the minimum age required by your jurisdiction).

3. ACCOUNTS AND SECURITY

You're responsible for:

• Keeping credentials secure
• Activity under your account
• Notifying us of unauthorized access

4. SERVICE CHANGES; AVAILABILITY

We may modify, suspend, or discontinue any part of the Service at any time. We do not guarantee uptime, uninterrupted access, or error-free operation.

5. USER CONTENT

You retain ownership of content you create/store in the Service ("User Content").

You grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, process, and display User Content only as needed to operate and improve the Service.

You represent you have the rights to your User Content and that it does not violate law or third-party rights.

6. ACCEPTABLE USE

You may not:

• Reverse engineer or attempt to extract source code (except where prohibited by law)
• Circumvent security, probe systems, or access accounts without authorization
• Disrupt the Service, introduce malware, scrape, or abuse APIs
• Use the Service unlawfully or to violate others' rights

We can investigate and enforce, including suspension/termination.

7. INTELLECTUAL PROPERTY

The Service and all related IP belong to us or our licensors. Define My Day™ is a trademark. You may not use our branding without written permission.

8. SUBSCRIPTIONS, BILLING, AND REVENUECAT

Paid features may be offered via subscriptions.

A. Subscription Management

We use RevenueCat to manage subscription status and entitlements. Your purchase may be processed by app stores/platforms and their payment processors. Cancellation and renewal are controlled through the platform where you subscribed.

B. Renewal and Cancellation

Unless stated otherwise at purchase, subscriptions may auto-renew until canceled. You are responsible for canceling before renewal if you don't want to continue.

C. Refunds

Refunds (if any) are governed by the platform's policies (e.g., Apple/Google). We typically cannot override app-store refund decisions.

D. Price Changes

We may change pricing prospectively where allowed by law. If required, we will provide notice through the platform and/or the Service.

9. ADVERTISING AND MARKETING

The Service may include marketing attribution and analytics. We may run advertising campaigns with partners such as Meta, Google, and Reddit (and others). Your device/platform may provide ad controls (e.g., iOS/Android privacy settings). Your use is also subject to our Privacy Policy.

10. NO PROFESSIONAL ADVICE

The Service provides organizational tools and may display suggestions or insights. It is not medical, legal, financial, or professional advice. You are responsible for your decisions.

11. DATA LOSS, THEFT, AND BACKUPS — CRITICAL DISCLAIMER

You agree that:

• We are not responsible for loss, corruption, deletion, or unauthorized access to User Content or other data.
• Data loss can occur due to bugs, device failure, updates, sync conflicts, third-party outages, malicious attacks, user actions, or platform issues.
• You are responsible for maintaining backups to the extent you require.

12. THIRD-PARTY SERVICES

The Service may rely on third-party tools (hosting, analytics, crash reporting, RevenueCat, app stores). We are not responsible for third-party services and don't guarantee their performance.

13. TERMINATION

You may stop using the Service anytime.

We may suspend/terminate access if you violate these Terms, create risk/legal exposure, or if required by law, or if we discontinue the Service.

Upon termination, access ends and we may delete data per our retention practices and applicable law.

14. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND (EXPRESS, IMPLIED, OR STATUTORY), INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

15. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS/REVENUE/DATA/GOODWILL ARISING FROM OR RELATING TO THE SERVICE.
• OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF: (A) AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $100.

Some jurisdictions don't allow certain limits, so parts may not apply to you.

16. INDEMNIFICATION

You agree to indemnify and hold us harmless from claims, losses, liabilities, damages, and expenses (including attorneys' fees) arising from your use, your User Content, or your violation of these Terms or law.

17. DISPUTE RESOLUTION; ARBITRATION; CLASS ACTION WAIVER

Contact help@definedlife.com and allow 30 days to attempt resolution.

Arbitration

If not resolved, disputes may be resolved by binding arbitration rather than court, except small claims, unless prohibited by your local law.

Class Waiver

Disputes must be brought individually, not as class/representative actions.

18. GOVERNING LAW; VENUE

These Terms are governed by Pennsylvania law (excluding conflict-of-law rules). If arbitration is removed or unenforceable, you agree to jurisdiction/venue in state/federal courts in Allegheny County, Pennsylvania unless your local law requires otherwise.

19. CHANGES

We may update these Terms and will update the Effective Date. Continued use after changes take effect means you accept the updated Terms.

20. ENTIRE AGREEMENT; SEVERABILITY; ASSIGNMENT

These Terms + the Privacy Policy are the entire agreement. If any provision is unenforceable, the rest remains in effect. You may not assign these Terms without consent; we may assign in a business transfer.
